A closing statement is a summary of what the evidence shows.  It is not a time for the lawyer to give his opinion as to who did what, but to argue that the evidence is weak or insufficient to prove that the defendant did what is charged.

You could argue that the defendant paid the man more because he had more experience if that was put into evidence, or that he worked there longer therefore qualifying for raises which she would earn if she stays there.

The defense will have presented evidence of all other similar employees pay scales, and can argue that there are women who earn the same as the man, and other men who earn what the woman earns, or less.

OOPS, I just reread your question, if you are the defense attorney your client is the employer of the man who earns more, if you are the plaintiff&#039;s attorney you are the prosecution, and then your client is the woman who is suing.  Which are you??</description>
